1. The Contract
1.1 These terms of sale apply to all goods supplied by Home design choice.
1.2 No contract exists for the sale of any goods until we have received and accepted your order and received payment in full (in cleared funds).
1.3 The contract is subject to your right of cancellation (see below).
1.4 We may change these terms of sale without notice in relation to future sales.
2. Description and price of the goods
2.1 The description and price of the goods you order will be as shown on our website at the time you place your order.
2.2 Product descriptions are based on information supplied by the manufacturer. However, we will take all reasonable steps to ensure the accuracy of these descriptions.
2.3 The goods are subject to availability. We will make every effort to ensure that stock levels displayed on the website are accurate and will not knowingly offer goods for sale which are not available unless this is clearly marked as a pre-order product.
2.4 If the goods you have ordered are not available in stock, we will inform you as soon as possible and if a suitable delivery date cannot be agreed, refund or re-credit you for any sum that has been paid by you or debited from your account for the goods.
2.5 Every effort is made to ensure that prices shown on our website are accurate at the time you place your order. We reserve the right to refuse or cancel any orders if an error is found. In these circumstances, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order.
2.6 We cannot accept responsibility for the accuracy of adverts on third party websites which is outside of our control, and the information on www.mooresdirect.co.uk overrides this at all times. If you find inaccurate information on another website regarding our business, products or pricing, please inform us via our contact page, and we will try to ensure this is corrected or deleted
3.1 Payment for the goods and delivery charges can be made by any method shown on our website at the time you place your order. Payment shall be due before the delivery date.
3.2 When placing an order using your debit or credit card, a reserve is put on the funds to ensure they are available, but no money is debited from your account until we despatch your order
4. Your account
4.1 When registering with our website you should take all necessary steps to ensure that your password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
5. Dispatch and Delivery
5.1 Delivery rates shown on the website are for UK mainland only and do not cover the Highlands, Islands or Ireland. Delivery quotations for those areas can be provided on request.
5.2 International delivery is not available
5.3 We reserve the right to refuse delivery to an alternative address or unconfirmed PayPal address. We will notify you as soon as possible of this, and you will have the opportunity to provide further information, have the order delivered to the card billing, or confirmed PayPal address, or cancel the order.
5.4 Orders will be processed within 24 hours and will be delivered in line with the displayed delivery option provided no additional security checks are required and all stock items are available. (A working day is any day other than weekends and bank or other public holidays.)
5.5 The delivery options displayed are estimated delivery only and not guaranteed services. Whilst every effort will be made to deliver the goods within the estimated timescales, we will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. If delivery dates are critical, we can offer quotations for guaranteed delivery services on request
5.6 A signature is required on delivery of goods and we will not instruct courier services to leave parcels in sheds, outhouses, porches, garages or any other area
6.1 Ownership of the goods shall not pass to you until we have received in full (in cash or cleared funds) all sums due to it in respect of the order, and the goods have been delivered to you.
7. Your right of cancellation
7.1 You have the right to cancel the contract at any time for 14 days from the day of receipt of the goods.
7.2 To exercise your right of cancellation, you must notify us by letter, telephone, email or via the contact us page of our website, giving details of the goods ordered.
7.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost. The goods must be returned to the address shown below.
7.4 You must take reasonable care of the goods and ensure they are not damaged or used whilst in your possession.
7.5 We will refund or re-credit you for the goods and any delivery charge paid
7.6 If you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods or the cost of the goods themselves.
7.7 If delivery is refused, and the order subsequently cancelled, you will be liable for any additional charges levied by the courier service for processing and returning the order to us. This will usually be deducted from your refund total.
8.1 All goods supplied are guaranteed free from defects for a minimum of 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.
8.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the manufacturer, failure to follow the manufacturer’s instructions, or any alteration or repair carried out without our prior approval.
8.3 If the goods supplied to you are damaged on delivery, you must notify us within 3 working days.
8.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify us as soon as possible.
8.5 We will arrange and pay for collection or return of the goods, and repair, replacement or refund as appropriate
8.6 Goods which are subsequently found to be without fault will only be returned at your cost
9. Data Protection
9.1 We will adhere to the Data Protection Act 1998, and ensure your personal data is only used for the purpose it was supplied.
9.2 Personal data will NEVER be sold or traded to a third party without your prior consent.
9.3 We will take all reasonable precautions to keep the details of your order and payment secure but unless we are negligent, we will not be liable for unauthorised access to information supplied by you.
10. Applicable Law
10.1 These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
